Following a finding of improper provisions’ application concerning the disciplinary procedure, the NTA conducted an investigation in October 2022 in a municipality of the Region of Attica, on compliance with the applicable provisions regarding the procedures for disciplinary proceedings and the imposition of administrative measures (suspension) in the disciplinary case of a municipal employee against whom a criminal prosecution had been brought for an offence which may result in his dismissal from public service (with an irrevocable conviction).
Specifically, the employee allegedly used his contacts to promise a public appointment for a fee.
After the completion of the audit (January 2023), the following was found:
- The Mayor called the employee to apologize but for a long time (more than two years) he did not issue a disciplinary decision or refer the case to the competent Disciplinary Board.
- For more than one year after the relevant opinion of the competent Disciplinary Board, the Mayor did not place the employee on potential leave.
The competent NTA inspectors - auditors made proposals - recommendations in order for the municipality to take specific actions for the proper implementation of the disciplinary procedure and the procedures for the enforcement of the prescribed administrative measures.
Furthermore, disciplinary responsibilities were sought for the relevant findings by the competent disciplinary bodies.
It is worth noting that the e-Peitharxika online platform (https://e-peitharxika.aead.gr/ which will soon become operational, will contribute to the systematic monitoring of disciplinary procedures in order to take immediate action.
This is the online database maintained by the NTA in which the data for monitoring preliminary examination procedures’ progress, Administrative Inquiry, disciplinary proceedings and criminal cases related to disciplinary proceedings are registered. The e-Peitharxika shall also monitor disciplinary cases’ progress after the adoption of disciplinary decisions and in the event of legal proceedings.
